Talent visa USA (O-1A visa) +

Overview

The O-1A nonimmigrant visa or US Talent visa is available for foreign nationals, who possess extraordinary ability and would like to enter the United States for work purposes, without any age, residency, or quota restrictions, and allows them to live and work in the United States for 3+ years.

The O-1A nonimmigrant visa is tailored to individuals who possess extraordinary abilities in specific fields such as the sciences, education, or business.

This visa is special, as it allows its holders to petition and get residency approval not only for family members (O-3 visa), but for essential support team members, i.e. talents personnel and crewmembers (lab assistants, personal assistants etc.).

Who is eligible?

Any person qualifying to have an “extraordinary ability” is eligible.

What does this mean? It means you have to have a higher level of expertise that is common only to a relatively small percentage of professionals in your field. This definition applies to business owners and top managers, IT-specialists and freelance developers and many, many other skilled persons.

Visa requirements

In order to be classified as someone with “extraordinary ability”, applicants must meet at least three of the following statutory criteria:

1. Awards: receipt of a major, internationally recognized award (e.g., Nobel Prize) or a lesser nationally or internationally recognized award in your field.

2. Membership in associations: membership in associations that require outstanding achievements of their members, which are recognized nationally or internationally.

3. Published Articles About You: published material in professional or major trade publications, newspapers, or other major media about you and your work.

4. Expert role: evidence of your participation on a panel, or individually, as a judge of the work of others in the same or in an allied field of specialization.

5. Contribution: original scientific, scholarly, or business-related contributions of major significance in the field.

6. Published Articles With Your Authorship: authorship of scholarly articles in professional journals or other major media in your field.

7. Critical role: evidence of your employment in a critical or essential capacity for organizations and establishments that have a distinguished reputation.

8. High Salary: evidence that you have commanded a high salary or other remuneration for your services.

Talent visa USA (International Entrepreneur Rule) +

Overview

The International Entrepreneur Rule (IER) visa offers a pathway for foreign entrepreneurs to launch, grow and work for their startups in the United States for up to 5 years. Designed to attract innovative talent, this visa allows eligible individuals to reside in the U.S. while managing their business and contributing to the American economy.

Since it is not your typical visa or residency, but rather a parole (permission), there are options to apply for the same treatment for your spouse.

Who is eligible?

To qualify for the IER, entrepreneurs must meet specific eligibility requirements, including:

1. Startup Term: start-up entities must have been formed in the U.S. within the past five years.

2. Investment: The startup must receive a significant investment from U.S. investors (at least $264,147 from qualified U.S. venture capitalists, or $105,659 from U.S. government programs).

3. Business Viability: the startup must demonstrate potential for rapid growth and job creation.

4. Ownership: The applicant must hold at least 10% ownership of the startup.
